Re-making of Complaints for Which no Solutions have been Received from the District Offices

Basic Eligibility and Requirements

  1. When no solutions have been received to complaints made to the District Offices such complaint can be re-made to this division. There complaints will usually be handled by the Commissioner of Labour and the Deputy Commissioner of Labour.
  2. Complaints made on miscellaneous subjects will be taken into consideration.
  • Strikes and suspension of service
  • Complaints relating to emoluments of employees
  • Complaints relating to Employees Provident Fund
  • Complaints of urgent nature.
  • Complaints on irregularities in factories
  • On non-receipt of solutions through regional offices
  • Complaints against offices of the Department of Labour.

Complaints of the following nature will not be accepted

  • Complaints on closure of institutions.
  • Absence of particulars of the institution
  • Complaints which do not carry correct address

Methods of Submission
Complaint can be submitted by a letter addressed to the Commissioner General of Labour with full details.

Form: No prescribed form has been designed.

Step by Step Action
Step 1 - Submission of the complaint to the District Labour Office by the Complainant.
Step 2 - The District Office will conduct inquiries for granting a solution at the district level.
Step 3 - Arriving at a solution.

Note:
In case no solution is given by the District office.

  • Such complaint can be referred to the special Investigations Division by the Commissioner General of Labour.
  • The Special Investigation Division will conduct inquiries in order to examine the facts mentioned in the complaint.

In case the facts mentioned in the complaint are proved.

  • All the parties connected to the complaint will be summoned to the Special Investigation Division and an inquiry held.
  • Date of conducting the inquiry will be intimated in writing
  • Next step to be taken will be decided upon the findings revealed by the inquiry .

In case justification of the complaint is not proved.

  • In case justification of the complaint is not proved by inquiries, the complaint will be rejected by the Inquiry Officer.

In case the inquiry revealed that the complaint concerned relates to a dispute that falls under the Industrial Dispute Act.;

  • Both the parties will be persuaded to arrive at a conciliation between them.
  • If both the parties agree to conciliation proposal , the complaint would be solved.

If the parties do not agree to the proposal:

  • It will be referred to the Industrial Relations Division
  • There merits will be considered for into submission to an arbitration.
  • Then the Commissioner General of Labour will forward it to the Minister for approval of its submission to arbitration.
  • On Ministers approval of its submission to an arbitrator, it will be referred to an arbitrator of labour.

There is no specified period for this. Period has to be decided on the following facts.

  • Nature of the complaint
  • Participation of the parties concerned.

    Usually a period ranging from 2 months to one year will be taken.

  • When letters are handed over personally.
  • On Working Days : On Mondays and Wednesdays
    Opening Hours : 09:00 a.m - 12:00 noon, 1:30 p.m - 4:00 p.m.
    On Holidays : Office is closed on all public holidays and mercantile holydays.
  • Complaints can be sent by post irrespective of any specified dates.

Period of validity: Complaints will be valid until they are inquired into.

Expenditure on Service

Applications: No specific form has been designed.

Fees: No fees will be charged from the public for this purpose.

  • Employees Provident fund and Employment Trust Fund records.
